Fitzly is a brand owned and operated by 30 ACRES LLC (“30 ACRES,” “Fitzly,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of shopfitzly.com (the “Site”), your purchase and use of Fitzly products, and your use of any services provided by Fitzly or 30 ACRES LLC (collectively, the “Services”).

Please read these Terms carefully before accessing the Site or purchasing our products.

By accessing the Site, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Site or Services.

1. ELIGIBILITY

Our Site and online purchasing Services are intended for adults who are legally capable of entering into binding agreements.

If you are under the age of majority in your state, you may use the Site only with the involvement and permission of a parent or legal guardian.

Our online Services are not intended for children under 13 to independently create accounts, make purchases, subscribe to marketing, submit personal information, or otherwise transact with Fitzly.

Parents and legal guardians are responsible for supervising a minor's use of Fitzly products.

2. PRODUCTS

Fitzly sells jewelry and related products, including earrings designed for everyday wear.

We make reasonable efforts to accurately display and describe our products. However, actual products may vary slightly from photographs or descriptions due to:

• Screen and monitor settings

• Lighting and photography

• Manufacturing tolerances

• Material variations

• Product batches

• Hand-finishing or production differences

Colors, dimensions, finishes, stones, enamel, plating, and other product characteristics may therefore vary slightly.

Minor variations that do not materially affect the function of a product are not considered defects.

We reserve the right to modify, discontinue, or limit quantities of any product at any time without prior notice.

3. JEWELRY MATERIALS AND PRODUCT INFORMATION

Fitzly provides product descriptions and information based on specifications available to us from manufacturers, suppliers, testing information, and other sources we reasonably believe to be reliable.

Where applicable, Fitzly products may be described as containing materials such as stainless steel, 18k gold plating or PVD coatings, enamel, cubic zirconia, or other materials identified on the applicable product page.

Because manufacturing processes and individual sensitivities vary, Fitzly does not guarantee that any jewelry product will be suitable for every individual.

Customers should review the product description and materials before use.

4. SENSITIVE EARS, HYPOALLERGENIC PRODUCTS, AND INDIVIDUAL REACTIONS

Certain Fitzly products may be described as hypoallergenic, designed for sensitive ears, or similar language.

These descriptions refer to the materials and design characteristics of the product and are not a guarantee that an individual will not experience irritation, sensitivity, or an allergic reaction.

Individual sensitivities vary.

Fitzly products are consumer jewelry products and are not medical devices. Information provided by Fitzly regarding sensitive ears, materials, comfort, or jewelry care is provided for general informational purposes and is not medical advice.

If irritation, swelling, redness, pain, discharge, rash, or another adverse reaction occurs, discontinue use and seek appropriate medical advice when necessary.

Customers with known metal allergies or significant sensitivities should review product materials and consult an appropriate healthcare professional if they have questions regarding whether a particular product is suitable for them.

5. PIERCINGS AND HEALING

Fitzly jewelry is not intended to replace professional piercing services or medical advice.

Unless a particular product is specifically marketed for that purpose, Fitzly jewelry should not be assumed to be appropriate for use during the initial healing period following a new piercing.

Follow the instructions provided by your professional piercer or healthcare provider regarding piercing care, healing times, jewelry changes, and signs of infection or complications.

Do not use Fitzly products to pierce ears.

6. CHILDREN, SMALL PARTS, AND ADULT SUPERVISION

Jewelry contains small components and may present choking or other hazards if swallowed, inhaled, or improperly used.

Fitzly jewelry is not a toy.

Products intended to be worn by children should be used with appropriate adult supervision.

Parents and guardians are responsible for determining whether a product is appropriate for a particular child based on the child's age, maturity, behavior, sensitivities, and circumstances.

Jewelry should not be placed in the mouth.

Keep loose earrings, backs, charms, packaging, and other small components away from infants and young children.

Immediately discontinue use of damaged, broken, or loose jewelry.

7. SCREW-BACK EARRINGS

Certain Fitzly earrings use screw-back closures.

Screw backs may loosen over time through normal wear and movement.

Customers and caregivers are responsible for checking screw backs regularly to ensure they remain properly secured.

Do not overtighten screw backs, as excessive force may damage the post, threading, backing, or other components.

Fitzly is not responsible for earrings or components that are lost as a result of normal wear, failure to regularly check the backing, improper installation, misuse, or other circumstances outside our reasonable control.

8. WATER, SWEAT, AND EVERYDAY WEAR

Certain Fitzly products may be described as water resistant, sweat resistant, tarnish resistant, or suitable for everyday wear.

These terms describe intended product characteristics under ordinary use and do not mean that a product is indestructible, permanently waterproof, or guaranteed never to tarnish, fade, scratch, discolor, or otherwise show wear.

The appearance and lifespan of jewelry may be affected by exposure to:

• Chlorine

• Salt water

• Chemicals

• Cleaning products

• Perfume

• Cosmetics

• Lotions

• Sunscreen

• Hair products

• Perspiration

• Extreme heat

• Abrasion

• Improper storage

• Individual body chemistry

Customers should follow Fitzly's jewelry care instructions to help maintain their products.

Normal wear and tear is not considered a manufacturing defect.

9. PRODUCT CARE

Customers are responsible for reasonably caring for Fitzly products.

We recommend:

• Checking screw backs regularly

• Keeping jewelry clean

• Allowing jewelry to dry when appropriate

• Avoiding unnecessary exposure to harsh chemicals

• Storing jewelry in a clean, dry location

• Avoiding excessive bending, pulling, or force

• Inspecting jewelry periodically for damage or loose components

Do not continue using jewelry that appears damaged, broken, excessively worn, or unsafe.

10. PRICING AND PRODUCT AVAILABILITY

All prices displayed on the Site are in U.S. dollars unless otherwise indicated.

Prices, promotions, discounts, and product availability may change without notice.

We reserve the right to correct typographical errors, pricing errors, product-description errors, or other inaccuracies.

If an obvious pricing or listing error affects an order, we may cancel the affected order and issue a refund of amounts paid for the canceled item.

Placing an order does not guarantee acceptance of that order.

11. ORDERS

We reserve the right, to the extent permitted by law, to accept, decline, limit, or cancel an order.

Reasons may include:

• Product unavailability

• Suspected fraud

• Payment problems

• Pricing or listing errors

• Unusually large quantities

• Resale activity

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order.

Payments may be processed using Shopify Payments, Shop Pay, Apple Pay, supported credit or debit cards, and other payment options displayed during checkout.

You represent that you are authorized to use the payment method submitted with your order.

We reserve the right to cancel or delay orders when payment cannot be verified or when fraud is reasonably suspected.

13. SHIPPING AND DELIVERY

Customers are responsible for providing accurate and complete shipping information.

Shipping and delivery estimates are estimates only unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, holidays, transportation disruptions, incorrect addresses, or other events.

Risk of loss and title will transfer as provided by applicable law and the shipping terms presented at checkout.

14. RETURNS, REFUNDS, AND EXCHANGES

Purchases are subject to the Fitzly Return and Refund Policy in effect at the time of purchase.

Because earrings are personal-wear products, return eligibility may be limited for products that have been worn, used, damaged after delivery, or otherwise made unsuitable for resale, subject to applicable law.

Customers should inspect products promptly after delivery and contact us within the period specified in our Return and Refund Policy regarding damaged, defective, or incorrect merchandise.

Nothing in these Terms eliminates any rights or remedies that cannot lawfully be excluded.

15. PROMOTIONAL CODES AND DISCOUNTS

Promotional codes and discounts:

• May have expiration dates

• May be limited to certain products or customers

• May not be combined unless expressly permitted

• Have no cash value

• May be limited to one use per customer or household

• May be subject to additional terms

We reserve the right to cancel or refuse promotional codes obtained or used through fraud, manipulation, unauthorized distribution, technical errors, or other misuse.

16. GIVEAWAYS, SWEEPSTAKES, AND PROMOTIONS

Fitzly may conduct giveaways, contests, sweepstakes, and other promotions.

Promotions may be governed by separate Official Rules.

Where Official Rules apply, those rules control the applicable promotion.

Unless expressly stated otherwise, purchases are not required to enter a sweepstakes, and making a purchase will not improve an entrant's odds of winning.

Promotions offered through Facebook, Instagram, TikTok, or another third-party platform are not sponsored, endorsed, administered by, or associated with those platforms unless expressly stated otherwise.

17. EMAIL AND SMS COMMUNICATIONS

If you voluntarily subscribe to Fitzly marketing communications, you may receive promotional email or SMS messages in accordance with your consent and our Privacy Policy.

Consent to receive marketing SMS messages is not a condition of purchasing goods or services.

Message frequency may vary. Message and data rates may apply.

You may unsubscribe from promotional emails using the unsubscribe link provided in the email.

You may opt out of marketing SMS messages by replying STOP to an applicable message.

Transactional communications relating to orders, shipping, accounts, customer service, security, or similar matters may still be sent where appropriate.

18. CUSTOMER ACCOUNTS

If the Site allows customer accounts, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms.

19. REVIEWS AND USER CONTENT

If you submit reviews, photographs, comments, testimonials, social-media tags, or other content to Fitzly, you represent that you have the right to submit that content and that doing so does not violate the rights of another person.

You retain ownership of your original content.

To the extent permitted by law, by voluntarily submitting content to Fitzly for publication or tagging Fitzly in content in a manner intended for brand interaction, you grant us a non-exclusive, royalty-free license to use, reproduce, display, and share that content in connection with operating, promoting, and marketing Fitzly, subject to applicable law and platform rules.

We reserve the right to moderate or remove content from channels we control when appropriate.

20. INTELLECTUAL PROPERTY

The Site and its content, including Fitzly's names, logos, graphics, photographs, product names, product descriptions, designs, text, videos, layouts, and other original content, are owned by or licensed to 30 ACRES LLC and are protected by applicable intellectual-property laws.

Nothing in these Terms grants you ownership of Fitzly intellectual property.

You may not copy, reproduce, modify, distribute, sell, exploit, or commercially use our protected content without prior written permission, except as permitted by law.

21. PROHIBITED USES

You may not use our Site or Services to:

• Violate applicable law

• Commit fraud

• Submit false or misleading information

• Infringe intellectual-property rights

• Introduce malicious software

• Attempt unauthorized access to our systems

• Scrape or harvest information in violation of applicable law or our rights

• Impersonate another person

We do not control independent third-party websites or services.

Statements made by Fitzly concerning sensitive ears, jewelry materials, piercing care, comfort, product use, or related subjects are provided for general informational purposes only.

Nothing on our Site, social-media accounts, packaging, marketing materials, or communications constitutes medical advice, diagnosis, or treatment.

Fitzly products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always seek appropriate professional medical advice regarding health concerns.

24. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT FOR ANY EXPRESS WARRANTY PROVIDED BY FITZLY.

TO THE FULLEST EXTENT PERMITTED BY LAW, 30 ACRES LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

SOME STATES DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

25. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 30 ACRES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, SERVICES, OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO 30 ACRES LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

26. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless 30 ACRES LLC and its members, managers, employees, agents, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Site or Services, your violation of these Terms, or your infringement of another person's rights.

This provision does not require you to indemnify any party for conduct for which indemnification cannot lawfully be required.

27. FORCE MAJEURE

To the extent permitted by law, we will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disruptions, governmental actions, internet or telecommunications failures, supply-chain interruptions, or similar events.

28. GOVERNING LAW

These Terms and disputes arising from them will be governed by the laws of the State of KANSAS, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

29. DISPUTE RESOLUTION

Before filing a legal claim relating to these Terms, you and 30 ACRES LLC agree to make a reasonable good-faith effort to resolve the dispute informally.

You may initiate this process by contacting us using the information below and providing a description of the dispute and the relief requested.

Nothing in this section prevents either party from seeking relief where an informal dispute-resolution requirement cannot legally be imposed or where immediate legal relief is appropriate.

Any additional arbitration, venue, jury-waiver, or class-action provisions should be expressly stated in these Terms and will apply only to the extent enforceable under applicable law.

30. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

31. NO WAIVER

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

32. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our products, Services, business practices, or applicable laws.

The updated Terms will be posted on the Site with a revised “Last Updated” date.

Changes will apply prospectively as required by applicable law.

33. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional terms expressly applicable to a particular product, promotion, or Service, constitute the applicable agreement between you and 30 ACRES LLC concerning your use of the Services.
